In re Aspartame: The E.D. Pa. Clerk of Courts Is Disposed to Award E-Discovery Costs; Litigants Still Need to Prepare for the Battle in District Court

The Clerk of Courts for the Eastern District of Pennsylvania this past week taxed antitrust class plaintiffs over $565,000 in e-discovery costs, following a final judgment on the merits in favor of the three defendants. The Clerk issued an opinion that establishes a standard for taxing e-discovery costs that is quite favorable to a prevailing party and adds to the potential trend of courts awarding e-discovery costs highlighted by the Race Tires America decision earlier this year.
