Experience and Background
Since joining Dechert, Richard J. Cutler has represented a large multinational pharmaceutical company in consumer fraud/government investigations as well as in a multi-district litigation alleging pricing fraud in federal and state courts. During the course of that representation, he has conducted civil pre-trial litigation while participating in a joint defense group, coordinating with other major law firms that were representing other large pharmaceutical companies in the same litigation.

In addition to his pharmaceutical litigation experience, Mr. Cutler has represented companies and individuals in federal white collar criminal investigations, including a large food processing company in an antitrust and fraud investigation and companies and individuals in securities fraud investigations.

Prior to joining Dechert, Mr. Cutler served for 10 years as an assistant U.S. attorney in California. During his tenure, he investigated and prosecuted a wide variety of white collar and violent crimes ranging from computer crimes and mail and wire fraud offenses to False Claims Act, aircraft parts fraud, and significant RICO prosecutions. While a federal prosecutor, Mr. Cutler tried many felony cases to jury verdict, authored appellate briefs, and argued appeals in the U.S. Court of Appeals for the Ninth Circuit.

Mr. Cutler also has extensive experience in the prosecution of environmental crimes including violations of the Clean Water Act, the Clean Air Act, Resource Conservation and Recovery Act, CERCLA, the Toxic Substances Control Act, and the Federal Insecticide, Fungicide, and Rodenticide Act. In addition, Mr. Cutler has been a frequent lecturer at both government and private sector environmental enforcement trainings throughout the nation. He has been recognized as one of the leading national experts on the investigation and prosecution of Concentrated Animal Feeding Operations ("CAFO") as a result of his work investigating and prosecuting violations of the Clean Water Act by large dairy farms.

Mr. Cutler's work as a federal prosecutor has also resulted in awards from various federal agencies including the Federal Bureau of Investigation, the Drug Enforcement Administration, the Environmental Protection Agency, the Defense Criminal Investigative Service, the Department of Homeland Security, the Department of Transportation, the U.S. Forest Service, and the Bureau of Land Management. In 2005, Mr. Cutler was presented with the Award of Excellence by the Federal Law Enforcement Officers Association for his work prosecuting United Aircraft and Electronics for aircraft parts fraud.

Prior to working as a federal prosecutor, Mr. Cutler was a deputy district attorney in San Jose, California (1990-95), where he tried to jury verdict felony cases involving gang violence and worked extensively in the civil and criminal enforcement of California state and local environmental statutes. During that time, he was a frequent lecturer at trainings run by the California District Attorney's Association. Prior to working in California, Mr. Cutler was also a supervising assistant district attorney in Brooklyn, New York (1983-88) where he tried to jury verdict many cases including homicides and armed robberies. Mr. Cutler also wrote and argued more than 50 appeals before the state's appellate courts and in the U.S. Court of Appeals for the Second Circuit.

Mr. Cutler is admitted to practice before numerous federal district and appellate courts.
