With increased, steady scrutiny, companies may need to provide greater justifications for reaching the conclusions they draw regarding disclosures. "Although the responses from the SEC and Government Accountability Office (GAO) have not been well-framed, litigation [regarding insufficient environmental disclosure] is inevitable," Cohen said.
