Douglas E. Fleming III

Douglas E. Fleming III is co-chair of Dechert’s product liability and mass torts practice and focuses on complex litigation, specifically matters concerning mass torts, product liability, environmental toxic torts and insurance. Mr. Fleming regularly represents clients from the chemical, pharmaceutical, medical device, consumer product, building materials and insurance industries. His clients have included numerous Fortune 500 companies located nationwide involved in mass tort litigation filed across multiple federal and state jurisdictions. 

Mr. Fleming has extensive experience litigating cases at both the trial and appellate levels throughout the United States, including examining and preparing witnesses for deposition, Daubert hearings and trial and legislative testimony. In addition to arguing complex motions before courts across multiple jurisdictions, Mr. Fleming has also written briefs in the United States Supreme Court. 

As a former New York City Public Attorney, Mr. Fleming has participated in numerous pro bono matters, acting as a key lawyer for the City of New York, as well as indigent plaintiffs and non-profit organizations. Mr. Fleming also serves as Co-Lead of the Firm’s pro bono housing project which seeks to provide representation to low-income tenants who live in substandard housing in violation of their rights.

Mr. Fleming is ranked Band 1 for Nationwide Product Liability: Toxic Torts by Chambers USA. He is also recognized as a leading lawyer in the area of Product Liability, Mass Tort And Class Action - Defense: Toxic Tort by The Legal 500 US. Mr. Fleming is part of a product liability team that has garnered numerous accolades over the past two decades, including Law360's Practice Group of the Year for Product Liability in 2018 and 2019, and New York Law Journal's Litigation Department of the Year for Product Liability in 2019, 2020, 2021, 2022 and 2023.

Prior to joining Dechert, Mr. Fleming was a partner at Quinn Emanuel Urquhart & Sullivan.

  • A building materials manufacturer in multi-district litigation, seeking monetary relief for allegedly defective products.
  • A major consumer product manufacturer in individual and aggregated product liability lawsuits alleging personal injuries and economic damages, as well as in related regulatory and legislative matters.

  • A leading property and automobile insurer in a variety of actions, including class actions, coverage actions, and commercial actions.
