Devin M. Swaney

Devin Swaney, a partner in Dechert's global finance practice, focuses on structured finance and real estate matters, with a particular emphasis on securitization and commercial mortgage-backed securities. In addition, he serves as a leader on the firm’s Innovation Task Force and as a Diversity and Inclusion Liaison Partner.

Mr. Swaney represents issuers, underwriters, mortgage loan sellers, servicers, investors, operating advisors and sponsors with respect to public and private asset-backed securitizations, and he works on commercial and government sponsored deals collateralized by performing, re-performing and distressed assets. He acts as counsel to registrants with respect to regulatory filings and reporting obligations under the Securities Act and the Exchange Act, and he represents financial institutions, funds and investors with regard to the creation, sale and purchase of interests and participations in commercial real estate and mezzanine debt.

He has significantly contributed to the firm’s response to changed regulations surrounding risk retention and has counseled many important clients on ways to structure to meet the new requirements. Collaborating with peer law firms, Mr. Swaney co-authored a Q&A series, aimed to facilitate implementation of the new regulations and clarify the law and potential impact for clients.

Mr. Swaney has consistently been recognized by industry publications for his work in real estate and structured finance, including The Legal 500 US. He is also recognized as a highly regarded lawyer for structured finance and securitization by IFLR1000.

Mr. Swaney has advised Freddie Mac, a leading issuer of agency guaranteed structured multifamily securities, in multiple securitizations totaling more than US$500 billion since 2009, including more than 75 deals in 2020.
