Katherine A. Burroughs is a partner in the finance and real estate group and the business restructuring and reorganization group. Her practice is focused in the commercial real estate capital markets, and her recent matters include representation of subordinate investors, CRE lenders, and loan special servicers in CMBS, CDO and high yield real estate transactions, including subordinate, bond acquisition, pooling and servicing agreement and other securitization document negotiation and analysis, bankruptcy structuring issues, loan acquisition and restructuring, and workout, bankruptcy and foreclosure matters. Ms. Burroughs was recognized as a leading lawyer for real estate law in of The Best Lawyers in America, honored by the American Bankruptcy Institute and elected a fellow of the American College of Real Estate Lawyers.
Ms. Burroughs is an avid writer and has received an award from the American Bankruptcy Institute as a top articles contributor. She co-authored the “Complex Loan Structures" and "Issues Arising in Connection with the Foreclosure or Other Enforcement of the Securitized Loan" chapters in the Mortgage and Asset-Backed Securitization Litigation Handbook, as well as a chapter on European CMBS servicing in Commercial Mortgage-Backed Securitisation: Developments in the European Market. Other articles include, “A Look at Courts’ View of Intercreditor Rights” (Bloomberg); “Forbearance Agreements” (New York Law Journal); “Treatment of Mortgage Loan Repurchase Agreements in Bankruptcy” (Dechert Restructuring and Reorganization Report). and “Recent Bankruptcy Cases Impacting Commercial Real Estate Financing and Securitization” (Pratt’s Journal of Bankruptcy Law). Ms Burroughs also speaks regularly on issues of interest to the CRE industry, including on panels at national and regional conferences sponsored by CREFC, MBA, IMN, ICSC and ABA, as well as Dechert and client hosted presentations. Her recent presentations include “Dodd-Frank Update: Overview of CMBS Final Risk Retention Rules”; “CMBS 2.1 For the Special Servicer”; “A/B Loan Modifications”; and “Issues in Companion Loan Structures".
In addition, Ms. Burroughs is active in Dechert’s diversity efforts, serving as past co-chair of the firm-wide Diversity Committee and founding partner of the LGBT Affinity Group. Due in part to the success of this group, Dechert has been recognized as a 2015 NYLJ Diversity Initiative Honoree as well as a Top Company for LGBT Equality in 2013.
