Employers are continuously faced with new challenges in managing the workplace. Among the most difficult claims employers face is retaliation. With the proliferation of state and federal laws and a trend in the courts that appears to favor such claims, employees are more likely than ever to bring a retaliation claim and nearly half of all charges filed with the EEOC included retaliation claims. Recognizing this trend, the EEOC earlier this year issued an extensive proposed update to its enforcement guide on retaliation which reflects the agency’s approach to this evolving area of the law. Employers need to understand this shifting landscape and adapt their policies and procedures. Join us for an informative program that will:
- Review the EEOC’s 2016 proposed update to its retaliation enforcement guide
- Update you on the latest whistleblower retaliation cases
- Deal with post-separation retaliation claims
- Discuss how to handle disciplinary issues with employees who have recently made a claim including what to do when an employee takes confidential information in support of a claim
- Provide a brief insight into retaliation claims in France and the United Kingdom
