Overview

Claims of corruption are being raised with increasing frequency by state parties seeking to undo contracts and renegotiate investment agreements. Disputes arising out of such allegations are often subject to international arbitration based on the terms of the parties’ contracts or an applicable international treaty. However, given procedural and evidentiary practices in international arbitration, the arbitral forum is often not well-suited to address corruption issues.

This seminar will address the limitations and opportunities of the international arbitral forum in dealing with corruption allegations, focusing on Dechert’s success in defeating such allegations through innovative procedural arguments and the marshaling of evidence. Using case studies based on disputes handled by Dechert’s international arbitration team, the seminar will address the organisation of the arbitral procedure, the use of mutual legal assistance treaties, the compelling of witness testimony, evidentiary burdens of proof and standards of proof, and the admissibility of evidence gathered through criminal investigation techniques.
