Employers Face New COBRA Requirements

The recently passed American Recovery and Reinvestment Act of 2009 creates a new COBRA premium subsidy for certain individuals and requires employers to provide notice of it both to employees who will be laid off in 2009 as well as to those whose employment has already been terminated. This update reviews the COBRA provisions, which are effective immediately and therefore require prompt action by employers and plan administrators.
