Employer’s Access of MySpace Group Page With Employee’s Consent Leads to Jury Trial

In the first case of its kind, the U.S. District Court in New Jersey recently ruled that an employer who asks an employee for access to a MySpace group discussion page devoted to complaining about the employer may have violated federal and state law. This update reviews the decision, which highlights the risks New Jersey employers face when they seek to intrude into areas—even on the Internet—that employees consider private.
