Employment Appeal Tribunal: Member of a Limited Liability Partnership Can Also Be an Employee

In a recent Employment Appeal Tribunal case, the EAT confirmed that a member of a Limited Liability Partnership can also be an employee. Given how employment law claims can arise from establishing employee status (and the potential tax consequences of such claims), the decision is a timely reminder that members of LLPs who are removed may seek to establish employment status in order to bring unfair dismissal claims. This update briefly reviews the case and its implications for employers.
