Merger Control: Germany Introduces Second Domestic Turnover Threshold

An amendment to the German Act against Restraints of Competition recently came into force that will reduce the need for merger control filings for smaller transactions, in particular mere “foreign-to-foreign” transactions with little effect in Germany. Accordingly, many buyers and sellers with operations, sales, or investments in Germany, as well as targets of German companies, will see a more streamlined merger process under certain circumstances.
