Predatory Pricing in the EU: The French Broadband Case

The European Court of Justice, Europe’s highest court, recently confirmed a decision by the European Commission sanctioning a subsidiary in the France Telecom Group for an abuse of its dominant position in the form of predatory pricing. This is one of the few predatory pricing cases to be brought before the ECJ. In this update, we examine the decision and compare the approaches taken by EU and U.S. authorities when assessing predatory pricing.
