New Bribery Legislation Now Enacted in the UK

The recently enacted Bribery Act creates among other things a new strict liability offence when a commercial organisation fails to prevent bribery. The scope of the Act is in several respects wider than the US Foreign Corrupt Practices Act 1977 (“FCPA”), so even FCPA-compliant procedures need to be reviewed to ensure that they will be sufficient to guard against the commission of offences under the Bribery Act, which has wide extra-territorial effect. The Bribery Act is reviewed in this update along with steps that businesses now need to take in order to protect themselves.
