New EU Rules for Distribution Agreements Take on Large Buyers and Internet Sales

The EU Commission recently adopted its revised vertical block exemption regulation accompanied by the publication of the vertical restraint guidelines. The improvements to the regime were made as a result of the increased power of large distributors and retailers and the growing significance of online sales. Due to the success of the vertical regime in reducing companies’ compliance costs, the new regime, which goes into effect June 1, 2010, is not a major overhaul, but rather an update of the old rules. This update examines the changes to the regime and how they will affect companies.
