Many issues can arise when a party to a litigation asserts the attorney-client privilege, but one that does not usually arise is “Was the lawyer in fact authorized to practice in some jurisdiction?” A court recently resolved the issue of what happens when the answer is “no” by rejecting a litigant’s assertion of privilege.
