Update on UK Bribery Act – Draft Guidance on Adequate Procedures

The Bribery Act creates a new strict liability offence when a commercial organisation fails to prevent bribery, the only defence to which will be that the organisation had put in place adequate bribery prevention measures. In January 2011, definitive guidance on such measures will be published, but on 14 September 2010 the Ministry of Justice published a draft of this guidance as part of a consultation process. This update summarises the draft guidance.
