Recent Developments in the Law Relating to Trustee Exoneration Clauses

The recent English case of Walbrook v Fattal and the Guernsey case of Spread Trustee v Hutcheson were attacks on standard exoneration clauses, designed to provide protection for trustees in an increasingly uncertain and hostile climate, and on the relief of professional trustees. Both failed. In this update we consider these developments in more detail.
