In its unanimous decision in Thompson v. North American Stainless, LP, the United States Supreme Court continued to expand the scope of Title VII’s anti-retaliation provisions. In this update, we examine this decision as well as recent developments under the Fair Labor Standards Act, the National Labor Relations Act and the WARN Act, and the increasing regulation of employers’ use of credit checks in making employment decisions.
