Improvements to the Asset-Backed Securitization Process

Subtitle D of Title IX of the Dodd-Frank Wall Street Reform and Consumer Protection Act pursues the general goal of investor protection in the specific context of asset-backed securitization (including commercial and residential mortgage securitizations). This update examines two of the main objectives of the Act: to implement structural changes in the issuance of asset-backed securities (“ABS”) to require risk retention by securitizers and originators; and to require enhanced disclosure relating to the securitized assets.
