What Are the Implications of the New China Guidance on Anti-Bribery Enforcement?

The Supreme People’s Court and the Supreme People’s Procuratorate of the People’s Republic of China issued the Interpretation of Several Issues Concerning the Specific Application of the Law in the Handling of Criminal Bribe-Giving Cases (the Interpretation) on 26 December 2012. The Interpretation came into force on 1 January 2013 and it introduced welcomed clarifications in some grey areas of the PRC’s anti-bribery laws. This article examines the motivation for the release of the Interpretation and its implications for companies doing business in China.
