Joseph F. Donley has successfully tried cases in state and federal courts in numerous jurisdictions as well as in multiple arbitration forums.

In securities litigation, Mr. Donley has represented public investment companies, investment partnerships, and private equity funds. He has won trials in recent years on behalf of private equity funds in the Delaware Chancery and New York federal courts. He also obtained dismissals on behalf of corporate defendants at an early stage in several recent securities matters, and has successfully prosecuted several cases involving the acquisition or transfer of bonds. Mr. Donley has also been active in merger and acquisition litigation and recently defeated an attempt to enjoin a business combination between publicly held medical device companies.

In commercial litigation, Mr. Donley has regularly appeared in state and federal courts in New York for three decades, including in cases involving contract, shareholder, real estate, securitization, and insurance coverage issues. For example, Mr. Donley won a trial in the Southern District of New York in consolidated cases involving insurance coverage issues in which his clients recovered the maximum permitted under the policy. His experience in arbitration includes numerous disputes among shareholders in privately held corporations. In recent arbitrations, he has obtained multi-million dollar awards for the claimants in a real estate valuation matter involving a prominent New York office tower, and in a contract dispute between telecommunication companies.

Mr. Donley has also been retained on numerous occasions to defend and prosecute appeals. He recently won an appeal before the U.S. Court of Appeals for the Second Circuit that resulted in a landmark opinion on standing under the federal racketeering laws.

Mr. Donley is a Recipient of The Boris Kostelanetz President’s Medal (2013) from the New York County Lawyers’ Association.
