Nathan Hoffman is a trial lawyer with extensive experience in state, federal and multi-district litigation concerning product liability, consumer fraud class actions, antitrust, and white collar criminal defense matters. He has particular expertise in handling matters for clients in the pharmaceutical, healthcare, consumer products, and automotive industries.

Currently, Mr. Hoffman represents Purdue Pharma in In re National Prescription Opiate Litigation, MDL 2804, N.D. Ohio (J. Polster), and related state court litigation. Mr. Hoffman also represents AbbVie Inc. in In re Testosterone Replacement Therapy Products Liability Litigation, MDL 2545, N.D. Ill. (J. Kennelly), and related state court litigation, and was co-trial counsel for AbbVie in its first three bellwether trials in the MDL. In addition, Mr. Hoffman was actively involved in the defense of Takata Corporation regarding both criminal and civil allegations related to the company’s airbag recalls, the largest in U.S. history. For more than 10 years, Mr. Hoffman represented Pfizer Inc. (and, previously, Wyeth Pharmaceuticals, Inc.) in In re Prempro Products Liability Litigation, MDL 1507, E.D. Ark. (J. Wilson), and related state court litigation. Mr. Hoffman was a member of several trial teams that secured full defense verdicts for Wyeth and Pfizer.

Mr. Hoffman has argued critical motions and appeals before both state and federal courts, including the U.S. Court of Appeals for the Seventh Circuit, and has significant experience cross-examining expert witnesses on liability and medical causation issues in Daubert hearings.

In 2019, Mr. Hoffman was again recognized by The Legal 500 US for his product liability and mass tort defense practice in the areas of consumer products, pharmaceuticals and medical devices, and toxic torts.

Prior to joining Dechert, Mr. Hoffman was a partner in the Chicago office of another international law firm.

Experience
  • In re National Prescription Opiate Litigation: Purdue Pharma in hundreds of lawsuits involving OxyContin filed in both federal and state courts by public and private entities alleging RICO, consumer fraud, public nuisance, and negligence claims related to opioid abuse, addiction, and diversion.
  • In re Testosterone Replacement Therapy Products Liability Litigation: AbbVie in national product liability litigation related to AndroGel, a prescription testosterone replacement therapy product. Mr. Hoffman was co-trial counsel for AbbVie in the first three MDL bellwether trials, each resulting in no damages recovered by Plaintiffs.
  • In re Takata Airbag Litigation; Takata Corporation in connection with the largest recall in U.S. history, resulting civil litigation, and investigations of airbag inflator ruptures by the National Highway Traffic Safety Administration, Congress, and the Department of Justice, among other entities.
  • Former CFO of Walgreens in a high-profile defamation lawsuit that garnered significant national press.
  • In re Prempro Products Liability Litigation: Wyeth Pharmaceuticals, a subsidiary of Pfizer, in several successful jury trials resulting in full defense verdicts regarding product liability and fraud claims in both state and federal courts.
  • U.S. Department of Justice vs. Microsoft Corporation: Microsoft in obtaining a complete victory in the remedies phase of a high-profile antitrust lawsuit.
  • Roquette v. A.E. Staley, Tate & Lyle plc et al.: Tate & Lyle plc, a UK company, and its U.S. domestic subsidiary against claims of trade secret misappropriation, RICO and Lanham Act violations filed in Iowa and New York by French company Roquette Freres and its U.S. subsidiary.
  • In re High Fructose Corn Syrup Antitrust Litigation: A.E. Staley Manufacturing in securing a successful settlement in a nationwide antitrust class action alleging that Staley and its co-defendants conspired to fix the price of high-fructose corn syrup.
  • A leading cell phone manufacturer in an internal investigation of theft and trade secret misappropriation regarding high-value prototype smartphones.
  • Defending a nationally recognized sports equipment manufacturer in head-injury litigation regarding claims of product liability and design defect.
  • A physician in a criminal matter regarding federal Anti-Kickback Statute and health care fraud claims.
