Robert J. Jossen is the past Chair of Dechert’s global litigation practice. A Fellow of the American College of Trial Lawyers, Mr. Jossen has tried to verdict more than 40 cases, including numerous non-jury trials and arbitrations in courts and forums throughout the United States. In addition, he has handled many preliminary injunctions and other hearings, and has represented clients in matters before the Department of Justice (DOJ), the Securities and Exchange Commission (SEC), the New York Stock Exchange, FINRA, and other federal and state regulatory bodies. Mr. Jossen focuses on complex commercial litigation, securities and white collar criminal defense, and legal ethics.

Prior to entering private practice, Mr. Jossen was Chief Appellate Attorney in the U.S. Attorney’s Office for the Southern District of New York and earlier an Assistant U.S. Attorney. He began his legal career as a law clerk for the Honorable Marvin E. Frankel of the U.S. District Court for the Southern District of New York.

Mr. Jossen has been consistently ranked as a leading lawyer for white-collar crime and government investigation in Chambers USA, a referral guide to leading lawyers in the United States based on the opinions of their peers and clients, raving that he is "very knowledgeable, has a great sense of strategy and is really good at looking down the road and seeing how the case will proceed." Mr. Jossen has been recognized for his white-collar criminal defense practice by The Legal 500 US, which praised his "ability to advise clients, address client needs and manage litigation." He is also regularly listed by The Best Lawyers in America for bet-the-company litigation, commercial litigation and white-collar criminal defense. Benchmark Litigation has regularly recognized Mr. Jossen as a “Litigation Star” for his white-collar criminal defense and general commercial litigation practices, and in 2014 applauded him for being “highly regarded among peers.” Mr. Jossen has also been named to Global Investigations Review’s list of “Who’s Who Legal Investigations 2015,” and has been listed for more than 20 years as one of the best commercial and white collar criminal defense litigators in the country in the Best Lawyers in America.

Mr. Jossen is the author of numerous articles on litigation issues, including Chapters in Treatises on Privacy and Trademark Litigation. He is a frequent lecturer on litigation, ethics and other professional responsibility issues. Mr. Jossen was the recipient of the Judge Simon Rifkind Award from the Jewish Theological Seminary in 2009 and the Torch of Learning Award from American Friends of Hebrew University in 1997.

Mr. Jossen has been retained to lead internal investigations on behalf of major public companies. For example, he conducted the Rite Aid internal investigation, which resulted in a significant restatement of the company’s financial statements and the ouster and subsequent criminal prosecution of management. He provided guidance to the company’s Audit Committee and Board in their efforts to restore stability. In addition, he led internal investigations for Beth Israel Medical Center and its parent company, Continuum Health Partners, and Nash Finch Company with regard to accounting practices. He also has been involved in numerous non-public investigations representing individuals and advises audit committees and boards of directors in connection with SEC and other regulatory matters.

  • Represented affiliate/subsidiary of international US corporation in active FCPA investigation relating to alleged bribery in Middle East.
  • Represented a Special Committee of the Board of Directors of United Rentals, Inc. in response to an SEC investigation.
  • Represented the CFO of a major financial institution in a recent SEC investigation.
  • Represented former senior officers of a major financial institution in a recent joint SEC and DOJ investigation.
  • Represented a former senior officer of an international financial institution in a DOJ and UK investigation.
  • Represented several bank officials in the ongoing Libor investigation.
  • Represented senior officers of an international financial institution in investigations being conducted by the CFTC, the FSA, and the DOJ.
  • Represented the Hunts Point Terminal Produce Cooperative Association, Inc at trial in a corporate valuation proceeding resulting in a successful decision in July 2011.
  • Represented officers and employees of Salomon Smith Barney in investigations by the U.S. Attorneys’ Office, the SEC, and the Antitrust Division of the DOJ.
  • Successful resolution of the governmental investigations and securities class action involving the Vesta Insurance Group.
  • Represented outside directors of Xerox Corporation in connection with various civil litigations arising from Xerox’s restatement of its financial statements.
  • Represented EisnerAmper, LLP in various accounting litigations pending in New York State Supreme Court.
  • Represented employees or former employees of two major investment banks and other public companies in a variety of ongoing SEC investigations.
  • Lead trial lawyer in a well-publicized case in the New York Surrogate’s Court involving the Andy Warhol Estate.
  • Lead counsel in a jury trial in the U.S. District Court for the Eastern District of New York in which Mr. Jossen represented a private bus company against the Board of Education of the City of New York in a breach of contract/federal civil rights action.
  • Lead trial counsel in a six-week jury trial in Hawaii’s federal court involving Shasta Beverages.
  • Led a successful arbitration for the Ministry of Defense of the Israeli Government in the United States involving technical aerospace issues.
  • Lead counsel in two significant trademark infringement cases, one in New York and one in California.
  • Lead trial attorney in several proxy contests in California, New York, and Omaha, Nebraska.
