Elina Lin focuses her practice on cross-border commercial litigation and international arbitration. She has considerable experience in the enforcement of foreign judgments and arbitral awards in China.

Ms. Lin advises major Chinese and multinational companies on PRC-related corporate matters, including mergers and acquisitions, foreign direct investment, private equity, venture capital, and general corporate matters. She has represented clients from various sectors and industries, including manufacturing, franchising, healthcare, food and beverage, technology and energy.    

Prior to joining Dechert, Ms. Lin worked in the Shanghai office of a domestic law firm.

Experience

Commercial Disputes Resolution

  • Represented a multinational securities trading company in defending potential criminal claims involving allegations of market manipulation and commercial bribery.  
  • Helped enforce a substantial HKIAC arbitral award in China on behalf of a leading global energy company.
  • Represented a Southeast Asian company in enforcing a U.S. judgment in China.
  • Recovered sovereign assets on behalf of the State of Bolivia subject to judicial auction by a Chinese local court.
  • Represented a Chinese company in its dispute with a U.S. company and its parent company relating to an EPC contract located in Latin America.
  • Involved in the set-aside proceeding in an ICC arbitral award in Singapore from a Chinese state-owned construction company.
  • Represented a major railway vehicle manufacturing company in international arbitration, defending the client against claims of defective products. 

Mergers and Acquisitions

  • Represented Shanghai Shenda, a publicly listed state-owned enterprise in Shanghai, on its acquisition of 70% interest in IAC’s soft trim and acoustics business. Then, crafted the formation of a global joint venture to supply soft trim and acoustics products to automotive equipment manufacturers globally.
  • Represented a major French asset management company on its acquisition of a pharmaceutical company indirectly controlled by a Chinese listed enterprise.
  • Represented a multinational enterprise on its sale of an international plastic films/film laminates business to a well-known U.S. company.  

Private Equity and Venture Capital

  • Represented a famous U.S. electronic brokerage firm on its Series B investment in a Chinese leading IT company.
  • Represented a Chinese pharmaceutical company on its Series C and Series D financing.
  • Represented a Chinese investment company on its venture capital investment in Singapore with a major Chinese commercial media outlet company.

Antitrust

  • Represented a major oil and gas developer based in United Arab Emirates in an antitrust investigation on a proposed acquisition of a jack-up rig business, between two global leaders in the offshore oil rig industry.
