Benjamin McAnaney focuses his practice on products liability and mass tort litigation, with a focus in the medical device and pharmaceutical fields. He also has significant experience in antitrust and competition law, where he has represented and advised clients from a range of industries in all aspects of compliance, regulation, and litigation. Mr. McAnaney also has extensive complex commercial litigation experience, and has represented clients in contract, insurance, arbitration, and qui tam actions.

In addition to his litigation work, Mr. McAnaney maintains an active pro bono practice assisting individuals with criminal appeals, INS deportation appeals, and matters pertaining to identity theft. 

Mr. McAnaney frequently contributes to publications related to his practice. Examples of his recent work include Pennsylvania Motion Practice (2016), the ABA’s 2nd Edition of Proof of Conspiracy Under Federal Antitrust Laws, and Annual Review of Antitrust Law Developments (2018). 

Prior to joining Dechert, Mr. McAnaney served as general counsel for a private technology start-up, where he handled all legal and business development matters for a group of entertainment and social networking companies.

  • A pharmaceutical company in defense of "pay-for-delay" actions related to drug development. 
  • A leading gypsum wallboard manufacturer in the defense of antitrust suits filed by direct, indirect and opt-out purchasers. 
  • An pharmacy benefits manager against putative class action claims asserted under §1 of the Sherman Act based on alleged conspiracies with other pharmacy benefits managers and with their respective clients to depress the prices paid to independent retail pharmacies for filling prescriptions.
  • A multinational consumer goods company in state and federal products liability cases alleging neurlogical injuries from the use of dental products.
  • A European telecommunications company in ICSID arbitration against a foreign government following the seizure and nationalization of private property. 
  • A member of the United States House of Representatives in an ethics committee investigations.
