Kirti Sarkar focuses her practice on commercial real estate finance.

Ms. Sarkar represents institutional lenders in the origination of CMBS and balance sheet mortgage and mezzanine loans secured by various types of collateral including nursing homes, hotels, apartment buildings, office buildings, shopping centers, regional malls and mixed use properties. She has significant experience financing complex real estate collateral including ground-leased properties and condominiums. She also represents lenders buying and selling whole loans, notes and participations.

Ms. Sarkar also represents CMBS servicers in connection with loan assumptions, equity transfers, and other loan modifications and borrower requests. She represents borrowers in connection with financing-related matters for their real estate portfolios as well.

Prior to joining Dechert, Ms. Sarkar worked at a large international firm where she represented lenders and borrowers in commercial mortgage loan originations. Her previous experience also includes internships at the in-house legal department of Checkpoint Systems, Inc., at the Pennsylvania Human Relations Commission, and at the chambers of the Honorable Bernard Friedman, Judge for the United States District Court in the Eastern District of Michigan.

Significant Representations

  • Represented a large real estate investor as borrower in connection with various financing matters on its multistate healthcare property portfolio, including refinancing a US$1 billion mortgage and mezzanine loan secured by a 167 property healthcare portfolio across 19 states; implementing an operator change and obtaining CMBS servicer consent to same; and subsequent loan compliance, loan modifications and property releases.
  • Represented a large institutional lender in origination of a US$112 million mortgage loan secured by a luxury hotel and resort in Hawaii.
  • Represented a large institutional lender in origination of a US$82 million mortgage and mezzanine loan secured by a luxury condominium building, including simultaneous sale of the mortgage loan.
  • Represented a large institutional lender in origination of a US$56 million mortgage and mezzanine loan secured by a multifamily apartment complex, including future advances for renovation.
  • Represented a CMBS servicer in connection with an assumption by a large institutional borrower of a US$75 million loan secured by a large downtown office building.
