The article focuses on the proposed requirement to ensure the fairness and integrity of high risk AI systems before they are introduced into the European market.
This article summarizes the requirements for conducting a “conformity assessment,” including unique considerations that apply to data-driven algorithms and outputs, the potential impacts of this new requirement on the market, and identifies some strategic considerations, including in the context of product liability litigation, for providers of AI systems and other impacted parties.
