Erica Fruiterman is an associate in Dechert’s antitrust/competition group. An experienced litigator, Ms. Fruiterman focuses her practice on antitrust disputes involving clients across a diverse set of industries, including technology, pharmaceutical, life sciences, agricultural products and automotive. 

Until recently, Ms. Fruiterman served as Special Assistant Attorney General for the State of Colorado. During her government service, she helped lead a suit brought by 38 State Attorneys General against Google alleging the maintenance of monopoly power. Before her appointment as Special Assistant Attorney General, Ms. Fruiterman was in private practice at a top AmLaw 100 firm.

  • Zillow in antitrust claims relating to the display of broker listing information. REX – Real Estate Exchange, Inc. v. Zillow, Inc. et al.
  • Upstream supplier to pharmaceutical manufacturer from product hop allegations in antitrust litigation brought by 42 states. State of Wisconsin, et al. v. Indivior Inc., et al.
  • Trade association in antitrust lawsuit concerning national milk output restrictions stemming from the national Herd Retirement Program. First Impressions Salon, Inc. v. National Milk Producers Federation.
  • The largest global manufacturer of orthotics and prosthetics in antitrust litigation before the Federal Trade Commission challenging the merger of two prosthetics manufacturers. In the matter of Otto Bock HealthCare North America, Inc.
  • The nation’s largest network of heavy and medium duty truck dealerships in several antitrust class actions in large MDL proceeding involving claims for alleged price-fixing of vehicle parts. In re Automotive Parts Antitrust Litigation.

  • Reproductive Rights – Appellate counsel for pro bono legal team representing coalition of doctors, medical administrators and professionals as amici before the U.S. Supreme Court in Whole Women’s Health v. Cole.
  • Pennsylvania Innocence Project and Innocence Network – Represented PA Innocence Project as amici before the Pennsylvania Supreme Court, involving the appeal of the denial of a motion to suppress an involuntary confession, and raising an issue of first impression regarding the constitutionality of police interrogation techniques.
  • Board of Immigration Appeals – Represented the ACLU of Pennsylvania as amicus before the Court of Appeals for the Third Circuit arguing for reversal of Board of Immigration Appeals decision that conditioned the recognition of a proxy marriage on private decisions about whether to engage in physical intimacy.
  • Juvenile Law Center – Represented minors in appeal involving termination of a mother’s parental rights before the Superior Court of Pennsylvania and obtained affirmance of lower court’s decision.
