Jennifer Insley-Pruitt

Jennifer Insley-Pruitt focuses her practice on intellectual property counseling, enforcement, and litigation. She has extensive experience handling trademark, copyright, false advertising, right of publicity, and design patent disputes, including in federal court and before the Trademark Trial and Appeal Board. She frequently advises on trademark search, clearance, and prosecution and on the acquisition, sale, and licensing of intellectual property rights. She works with clients on the legal aspects of their advertising campaigns, ranging from pre-launch review to challenges in court and in the National Advertising Division. Ms. Insley-Pruitt has represented clients across a variety of industries, including financial services, fashion, entertainment, pharmaceuticals, technology, and consumer goods.

Ms. Insley-Pruitt is the author of multiple works on intellectual property law, including co-authoring a chapter on trademark litigation in Business and Commercial Litigation in Federal Courts, Fifth Edition (Thomson Reuters) and a chapter on ethics in trademark practice for INTA’s Trademark Administration. She has also frequently presented on intellectual property-related issues, and served as an adjunct professor at New York Law School, where she supervised a clinic on trademark prosecution.

In 2024 and 2023, Ms. Insley-Pruitt was recognized as a “World’s Leading Trademark Practitioner” in World Trademark Review’s WTR 1000. She has been identified in The Legal 500 for Intellectual Property: Trademarks, where client commentators described her as a “careful thinker, excellent strategy, and very hard working.” Ms. Insley-Pruitt has been consistently recognized by Super Lawyers New York in their intellectual property litigation category and has also been named a “Rising Star” by Managing Intellectual Property.

  • Represented The Cousteau Society in trademark infringement and right of publicity litigation in the District of Connecticut.
  • Defended Sheetz convenience stores in trademark and trade dress litigation against the manufacturer of Splenda.  
  • Defended Uptime Institute in trademark and false advertising case in the District of Nevada involving data centers.  
  • Defended Foreside Fund Services in trademark infringement litigation in the District of New Jersey involving use of an alleged trademark in a stock ticker.
  • Defended Flying Start Books in a trademark infringement litigation in the Southern District of New York involving children’s books publishers based in Australia and New Zealand. 
  • Represented LafargeHolcim in trademark infringement litigation in the District of Wyoming against mining industry startup. 
  • Represented major hotel company in trademark litigation brought in the Eastern District of Texas. 
  • Represented choreographer in copyright claim against production company, with dispute settled favorably to our client.  
  • Represented pharmaceutical company in false advertising dispute relating to competitive flea and tick control products for pets.
  • Represented luxury shoe company in trade dress and design patent litigations against competitors, with disputes settled favorably to our client.
  • Represented a multinational clothing retailer in a trademark opposition proceeding, obtaining a complete victory on the merits before the TTAB.  
  • Represented a fragrance company in false advertising litigation alleging false claims of discounts from retail rate, with dispute settled favorably to our client.
  • Represented jewelry company in copyright and design patent litigation alleging infringement of protected jewelry designs, with dispute settled favorably to our client.
  • Represented pharmaceutical company in false advertising challenge relating to advertising for infant formulas.
