Cross-Examination in International Arbitration: Theory and Practice

February 20, 2023
Singapore

Cross-examination has been described as the "greatest legal engine ever invented for the discovery of truth" (John Wigmore, Evidence 1st ed., 1904). It is an essential element of international arbitration, and yet it is seldom taught.

Please join us on 20 and 22 February for a two-part series on the theory and practice of cross-examination in international arbitration. In part one, participants will hear from leading counsel and arbitrators on the objectives, strategies and techniques for an effective cross-examination. Part two will be devoted to learning through practice, with participants given the opportunity to conduct short cross-examinations and receive feedback from experienced arbitrators.

Part One – Theory
1. Opening remarks – Rachel Tan, SIDRA (live)
2. The key principles of cross-examination – Mark Mangan, Dechert (live)
3. Unique insights from leading arbitrators – Prof Jan Paulsson, Neil Kaplan KC, Judith Gill KC, Michael Hwang SC, Prof Eduardo Silva Romero and Sapna Jhangiani KC (pre-recorded)
4. Comparison of cross-examination in common law and civil law contexts – Angela Ray Tumanan Abala, SIDRA (live)
5. The client’s perspective on cross-examination and witness preparation – Mariam Gotsiridze, former Head of Department in Georgia's Ministry of Justice (live)
6. Closing remarks and brief introduction to Part Two – Lukas Lim, Dechert (live)

Part Two – Mock Cross-Examinations

Participants will be given the opportunity to conduct short cross-examinations and receive feedback from leading arbitrators. The training exercise will be based on a fictitious problem developed by Dechert, which explores the tension between the energy-intensive crypto industries and the journey to net zero carbon emissions, thereby providing participants with a unique opportunity to learn about cross-examination through the prism of two trends which are likely to feature prominently in future disputes. (Observers will also be welcome.)
