Dechert Wins Significant Victory for State Farm in the Second Circuit
A Dechert team led by partner Douglas Dunham argued and achieved a significant victory for client State Farm in the Second Circuit in a case where plaintiffs alleged that their home was built with defective concrete, which was now causing their foundation to crumble. In its October 5, 2018 opinion in Kim v. State Farm, the Second Circuit held that State Farm, as a matter of law, had no liability on claims for breach of contract and deceptive trade practices to the plaintiffs, who were Connecticut homeowners insured by State Farm. The Second Circuit found that the plaintiffs’ claims were barred, among other things, by the cracking and defective materials exclusions in their insurance policy.
The Dechert team also included counsel Ellen Quackenbos who played a principal role in drafting the successful appeal briefs for State Farm.
