U.S. District Court Upholds Fiduciary Rule

On February 8, 2017, in Chamber of Commerce v. Hugler, the U.S. District Court for the Northern District of Texas upheld the new fiduciary “investment advice” rule of the Department of Labor (DOL) under ERISA. In doing so, the Court denied the DOL’s request for a stay of the court case while the DOL reconsiders the rule as directed by the President.
