New guidelines for assessing unfair dismissal damages in France

The so called Macron Act dated August 6, 2015 announced the introduction of non-binding guidelines to help labor court judges to award damages in case of unfair dismissal.

These guidelines have just been enacted (Decree No. 2016-1581 dated November 23, 2016, published on November 25, 2016).

The indicative grading scale for conciliation was also revised (Decree No. 2016-1582).

Both provisions come into force immediately.
