Dechert Files a Comment Letter in Response to the SEC Advisers Act Custody Rule Proposal
On May 8, 2023, Dechert LLP filed a comment letter with the SEC in response to a recently proposed rule that would overhaul the custody framework under the Investment Advisers Act for the safeguarding of advisory client assets. The SEC solicits these comments to help guide and inform its staff throughout the important rulemaking process.
The letter was in response to the SEC’s proposed new rule and rule amendments regarding how investment advisers safeguard client assets. The letter focuses on the how the SEC’s proposals may affect adviser trading in derivatives for client funds and accounts, and it includes comments intended to inform the SEC’s work as it works to finalize this important rulemaking.
