Anish Desai is a first-chair trial lawyer who leads complex competitor life science and technology cases in federal district courts, the U.S. International Trade Commission, the U.S. Court of Appeals for the Federal Circuit, the Patent and Trial Appeal Board, and in arbitration proceedings.
IAM Patent 1000 described Mr. Desai as a “smart attorney who is excellent at simplifying technical detail for judges and juries and great on his feet,” while Chambers USA notes that he “provides thoughtful, strategic advice” and “is excellent in court and a rising star; he is the next generation” in the patent litigation area.
- An e vapor product manufacturer as plaintiff in a patent infringement action relating to electronic nicotine delivery products. First chaired a jury trial that resulted in a US$95 million verdict in the Middle District of North Carolina and a post trial award of an ongoing royalty through the expiration of the patents.
- A pharmaceutical company in ITC, district court, inter partes review and Federal Circuit proceedings involving patent infringement claims by a competitor relating to eye treatment prefilled syringes and antitrust Walker Process claims. Led the ITC case in which the competitor withdrew its complaint two weeks before the evidentiary hearing, obtained an inter partes review final written decision invalidating the asserted patent as obvious and secured Federal Circuit affirmance of that decision.
- A pharmaceutical company in BPCIA litigation relating to eye treatment products.
- A chemical company in an ITC investigation against a competitor relating to crystalline modifications of pyraclostrobin used for crop protection.
- A medical device company in ITC, district court, inter partes review and Federal Circuit proceedings against a competitor concerning surgical staplers and robotic surgical systems.
- A global industrial company as plaintiff in district court patent and antitrust actions against a competitor. Obtained a US$170 million jury verdict for infringement of the client’s asserted patent in the Northern District of Texas and summary judgment of non infringement on the competitor’s asserted patent in the Middle District of Florida.
- An aerospace company in inter partes review proceedings and Federal Circuit appeals involving jet engine technology. Filed 36 inter partes review petitions challenging 31 patents, resulting in the patent owner disclaiming more than 200 claims and the PTAB finding more than 100 additional claims invalid.
- A software technology company in a Delaware patent infringement action relating to medical imaging technology. Obtained complete dismissal based on patent ineligibility under Section 101 at the pleading stage and argued the Federal Circuit appeal, securing a precedential opinion affirming the dismissal.
- A software technology company in a competitor dispute involving Delaware and Georgia patent and antitrust actions and inter partes review proceedings relating to speech recognition technology.
- A pharmaceutical company in litigation, inter partes review proceedings and Federal Circuit appeals relating to insulin formulations and delivery devices.
- A home security company in trade secret and patent arbitration proceedings involving home security and monitoring systems.
- A network security company in district court patent litigation relating to firewalls and managed security monitoring services.
- A consumer electronics company in district court and ITC investigations involving patent infringement claims relating to smartphones, messaging, WiFi, LED displays and digital cameras.
- A sportswear manufacturer in district court and inter partes review proceedings against a competitor concerning wearable devices and GPS technology.
