Austin Mooney

Austin Mooney is a trusted advisor and advocate for clients on their privacy and cybersecurity law challenges. Mr. Mooney represents clients ranging from startups to Fortune 500 companies in sectors including professional services, technology, healthcare, finance, real estate and entertainment.

Mr. Mooney crafts global privacy and cybersecurity programs tailored to clients’ business activities and risk profile. He develops practical solutions to address the often-disparate requirements under U.S. and international privacy laws, including the Federal Trade Commission (FTC) Act, the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) and other emerging and enacted privacy laws. His work spans privacy litigation and enforcement, cookie compliance, cross-border data transfers, incident response, cyber investigations and assessments, and federal and state surveillance laws including the Foreign Intelligence Surveillance Act (FISA).

Mr. Mooney advocates for clients before courts, regulators and in negotiations. He has particular experience negotiating Data Processing Agreements and other contractual terms governing data sharing between businesses, and regularly advises clients on developing positions and “playbooks” for these agreements. He also has experience advising clients on public policy and government affairs, having drafted legislation, rulemaking comments, letters to Congress and amicus briefs on technology policy topics.

He maintains an active practice advising on emerging legal issues related to the rise of artificial intelligence (AI) technologies. He has helped clients procure and implement these technologies, advised on AI privacy and security risks, advanced public policy initiatives on AI and counseled on internal AI governance and compliance activities.

Mr. Mooney also maintains an active immigration pro bono practice focused on representing asylum seekers.

Before entering private practice, Mr. Mooney was a law clerk for the United States Senate Judiciary Committee and held other positions with the FTC, the Network Advertising Initiative and as a research assistant for privacy law academic Daniel Solove.

Mr. Mooney is a Certified Information Privacy Professional/United States (CIPP/US) and a Certified Information Privacy Professional/Europe (CIPP/E).

  • Represented leading technology companies as amici curiae in United States Supreme Court surveillance law case United States v. Microsoft.
  • Authored and presented report on U.S. privacy and cybersecurity law for trade association's membership of Internet of Things (IoT) device manufacturers.
  • Advised a company on discussion draft of the CCPA, proposing changes that became law.
  • Developed legal strategy for a U.S. client following the European Court of Justice's Schrems II decision, including external communications on surveillance law exposure, transfer impact assessments (TIAs) and mitigating supplementary measures.
  • Represented a professional services firm in a CCPA compliance project including developing data subject response procedure, "Do Not Sell" analysis and framework, privacy notices and contracting playbook.
  • Represented a retailer in a credit card data breach response, including investigation, remediation, PCI-DSS compliance and notification of impacted cardholders.
  • Represented a device manufacturer in responding to dozens of law enforcement requests for customer data under the Electronic Communications Privacy Act (ECPA).
