David Marcinkus

Dave Marcinkus advises asset managers, investment funds and financial institutions on regulatory and compliance matters under the Investment Company Act and the Investment Advisers Act, with a particular focus on innovative fund structures and complex affiliated transaction issues.

Mr. Marcinkus brings more than a decade of experience at the U.S. Securities and Exchange Commission, as well as private practice at other international law firms and in-house.

Most recently at the SEC, Mr. Marcinkus served as Counsel to Chairman Paul Atkins and Acting Chairman Mark Uyeda, advising on policy and regulatory matters affecting the asset management industry. Previously in the Division of Investment Management, he was a Branch Chief in the Chief Counsel’s Office, where he worked extensively on issues affecting alternative asset managers, business development companies and closed-end funds.

Mr. Marcinkus has particular expertise in affiliated transaction matters under the Investment Company Act and played a key role in streamlining co-investment relief. He also served as a Branch Chief in the Division’s Enforcement Liaison Office, advising the Division of Enforcement on asset management matters.
