Priyata Patel is a partner in Dechert’s Washington, D.C. office and a member of the firm’s intellectual property practice. She represents clients in disputes before U.S. district courts, the U.S. Patent and Trademark Office (PTAB) and the U.S. International Trade Commission (ITC), as well as in appeals before the U.S. Court of Appeals for the Federal Circuit, often in concurrent litigations across multiple forums. Ms. Patel has experience in all aspects of case management and trial preparation, including claim construction, depositions, expert discovery and witness preparation at trial.
Ms. Patel advises clients on matters involving pharmaceuticals and medical device technologies, including biologics, small molecules, formulations, drug delivery, methods of treatment and surgical instruments.
- Regeneron Pharmaceuticals in multidistrict litigation brought under the Biologics Price Competition and Innovation Act against six biosimilar manufacturers, and in concurrent inter partes review proceedings, involving a recombinant fusion protein for the treatment of eye disease.
- BeOne Medicines in a post grant review proceeding before the PTAB involving a small molecule for the treatment of blood cancers.
- Regeneron Pharmaceuticals in competitor patent and antitrust litigation across the ITC, district court, PTAB, and the Federal Circuit relating to its blockbuster drug, including defeating a competitor's attempt to obtain an exclusion order at the ITC and invalidating the asserted patent in an inter partes review final written decision that was affirmed by the Federal Circuit.
- MARA Holdings Inc. in district court patent litigation relating to elliptic curve cryptography.
- Altria in district court litigation concerning e vapor and smoking cessation technology, culminating in a jury verdict awarding the company US$95 million in damages for past infringement and ongoing royalties.
- Ethicon in co pending ITC and inter partes review proceedings, district court litigation, and corresponding appeals involving advanced surgical stapling technology.
- BASF in an ITC investigation against a competitor relating to crystalline modifications of pyraclostrobin used for crop protection.
- Sanofi in district court litigation and inter partes review proceedings involving insulin formulations and delivery devices.
- Palo Alto Networks in district court patent litigation relating to firewalls and managed security monitoring services.
- Nuance Communications in a Federal Circuit appeal following dismissal under Section 101 of a patent infringement action concerning medical imaging technology, resulting in a precedential opinion affirming the district court's dismissal.
