Dechert’s success in securing vindication for Marriott International in a long-running antitrust dispute has been shortlisted for “Litigation of the Year – Cartel Defense” by Global Competition Review in this year’s GCR Awards, established to honor the world’s top lawyers, academics, economists and enforcers in the field of antitrust law.

An antitrust team led by Dechert partner Shari Ross Lahlou and with associate Thomas J. Miller successfully represented Marriott International in litigation with the TravelPass Group. One week into a trial before a jury in Texas federal court, TravelPass withdrew its claims that Marriott had conspired with other hotel chains to avoid competing over branded keyword advertisements. Marriott issued a statement regarding the conclusion of the matter, which includes TravelPass’s formal apology to Marriott and public acknowledgment that Marriott did not participate in any unlawful activity.

The case before the U.S. District Court for the Eastern District of Texas raised novel questions about the application of antitrust law to online search advertising and showcased the challenges of trying both antitrust and intellectual property claims together before a jury, especially in the context of evolving digital advertising markets.
