In recent months the Securities Exchange Commission’s views of cryptocurrencies and other digital assets have evolved and become more nuanced. Significant concerns remain regarding the potential for fraud and misselling, especially in the context of so-called “Initial Coin Offerings” or “ICOs.” However, the implementation of blockchain across numerous industry verticals – including financial services – is continuing to gain momentum, and fund managers should understand the more nuanced positions that are developing by U.S. regulators such as the SEC with regard to the regulation of digital assets as “securities."
