For decades, the SEC rules governing advertising and “cash solicitation” of clients by investment advisers have remained largely untouched. In November, the SEC proposed new advertising rules and updated solicitation rules that would modernize that guidance and would provide answers to certain (but not all) questions over which the private funds industry has long puzzled over.
