Dechert Secures Dismissal of Claims Against AmerisourceBergen Officers and Directors

A team of Dechert attorneys recently secured the dismissal of breach of fiduciary duty claims brought against officers and directors of AmerisourceBergen Corporation (“ABC”) in the Delaware Chancery Court. Plaintiffs sought to pursue derivative claims on behalf of ABC based upon the defendants’ alleged failure to monitor the Company’s distribution of controlled substances and alleged billions of dollars in damages. The Delaware Chancery Court held that the Plaintiffs failed to state a claim against the defendants and therefore lacked standing to pursue their claims.
