Seth Cumming is a barrister and an associate in Dechert’s international arbitration practice group. Mr. Cumming has 10 years experience as counsel, focusing on international commercial arbitration, investor-state arbitration and commercial litigation. He represents states and private investors in a variety of matters, including banking and financial services disputes, energy disputes and mining disputes. Mr. Cumming has appeared regularly as an advocate before ICSID tribunals, LCIA tribunals, ICC tribunals and the Courts of England and Wales.

  • Bay View Group LLC and The Spalena Company LLC in a claim brought against the Republic of Rwanda under the Rwanda – USA BIT in relation to the alleged expropriation of a mine. 
  • Cyprus Popular Bank Public in an ICSID arbitration regarding being placed under resolution following the Greek sovereign debt restructuring in 2011. 
  • Delta Holdings BV in an ICSID arbitration regarding the  collapse of the shareholder's bank when its licence was withdrawn by the National Bank of the Republic of Belarus following a currency crisis in late 2014. 
  • The shareholder of an Asian power plant in an ICC Arbitration in Singapore in relation to a claim against its gas supplier for breach of its gas supply contract.
  • A Polish corrugated iron manufacturer in an ICC Arbitration in London against a Chinese supplier for breach of its supply agreement.
  • An Eastern European Investor in a LCIA Arbitration in London against a fruit juice manufacturer for breach of an agreement to restructure and sell a business.
  • An Eastern European investor in a LCIA Arbitration in London regarding the breach of a settlement agreement following the acquisition of an Eastern European bank. 
  • Edmond de Rothschild Securities in Commercial Court proceedings in a claim about an entitlement to a success fee under an advisory agreement. 
  • Telekom Slovenije in Commercial Court proceedings regarding a breach of warranty claim under a Share Purchase Agreement.
