Debbie Green

Debbie Green is a commercial litigation partner whose practice spans the full range of complex disputes. Ms. Green brings particular depth in debtor reorganizations, representing debtors and creditors across commercial disputes related to complex chapter 11 bankruptcy cases, at the trial and appellate level, including contested reorganization proceedings, guaranty lawsuits, and fraudulent transfer litigation.  Her practice also encompasses insurance coverage and bad faith disputes, Telephone Consumer Protection Act (TCPA) class action defense and antitrust matters, giving clients a seasoned advocate across diverse litigation contexts.

Her experience extends to cross-border matters, including collaborating with UK counsel to represent an international telecommunications operator in International Chamber of Commerce (ICC) arbitration involving a dispute over cable capacity expansion rights, where she developed a New York law-based claim and defense strategies. She has also successfully managed TCPA putative class action defense – securing early favorable settlements – and has overseen appellate victories involving challenges to arbitration agreement enforceability, including delegation clause disputes grounded in waiver arguments.

Ms. Green has defended clients across a range of industries, including healthcare, energy, financial services and manufacturing, obtaining dismissals in matters alleging antitrust violations, professional malpractice and breach of fiduciary duty. Her work also includes representing senior executives – including former presidents, CEOs and directors of financial institutions – in securities fraud putative class actions.

  • Defended solar energy company in putative class action lawsuit alleging that it was liable for alleged personal and property damage resulting from severe winter storm.
  • Represented trustee of liquidation trust in action against government to recover tax refunds.
  • Represented debtors in numerous appeals arising from bankruptcy court orders entered in debtors’ favor in support of debtors’ efforts to manage complex reorganization.
  • Represented secured lender in bankruptcy proceedings challenging its exercise of Article 9 remedies in debtor's deposit accounts in its possession, including appeal.
  • Represented debtor operating a community of skilled residential nursing facilities and assisted living facilities in appeal of favorable decision in dispute with landlord over timeliness of its assumption of leases.
  • Represented stalking horse bidder in bankruptcy proceedings challenging its entitlement to administrative expense claim.
  • Defended petroleum refining company in fraudulent conveyance action and related lawsuits.
  • Defended operator of long-term acute care hospital in dispute with landlord over termination of essential services agreement.
  • Obtained dismissal of lawsuit against national real estate investment trust alleging conspiracy to violate antitrust laws.
  • Represented market maker in the business of selling vehicles to used car dealers in insurance coverage and unfair and deceptive settlement practices dispute, achieving favorable settlement.
  • Led defense of law firm in malpractice action, including before the United States Court of Appeals for the Fifth Circuit.
  • Secured favorable settlement on behalf of developer and marketer of vacation ownership products in sexual harassment and retaliation suit.
  • Represented former president, CEO and director of a bank in obtaining dismissal of securities fraud putative class action.
  • Represented manufacturer of lubricant and car care products in obtaining dismissal of lawsuit alleging violations of the Robinson-Patman Act and Sherman Antitrust Act.
  • Assisted Big Four accounting firm in obtaining dismissal of malpractice and breach of fiduciary duty causes of action.
  • Collaborated with UK counsel to represent international telecommunications operator in ICC arbitration involving dispute with cable capacity lessee over expansion rights, developing New York law-based claim and defense strategies.
  • Oversaw early favorable settlement of putative nationwide class action alleging violations of the TCPA.
  • Oversaw successful defense of appeal challenging enforceability of arbitration agreement's delegation clause based on claim of waiver through pre-litigation conduct.
