Agnese Whitt

Agnese Whitt is a skilled litigator in Dechert’s antitrust and competition group, specializing in antitrust and complex commercial disputes. She represents clients throughout the United States in federal and state proceedings and government investigations involving disputes related to antitrust and competition, contract and business tort. Ms. Whitt has experience with all stages of litigation, from early dispositive motions and complex discovery through class certification proceedings, summary judgment, and trial. Ms. Whitt has represented clients in a wide range of industries, including chemical and steel manufacturing, pharmaceutical, healthcare, technology, and media.

Ms. Whitt also maintains an active pro bono practice with a focus on civil rights cases.

  • CareFirst of Maryland v. Johnson & Johnson (E.D.Va.). Representing Johnson & Johnson in defense monopolization claims related to the monoclonal antibody Stelara.
  • In re Caustic Soda Antitrust Litigation (W.D.N.Y.). Defending a large chemical manufacturer in class action cases brought by direct and indirect purchasers claiming it participated in a price-fixing and supply reduction conspiracy in the caustic soda market. 
  • Defending a steel rebar manufacturer against two federal antitrust, predatory pricing, and common law tort actions filed by a customer and alleged would-be competitor related to a contractual exclusivity provision.
  • Fox Corporation in defending an antitrust lawsuit brought by Fubo against Disney, Fox and Warner Brothers relating to a proposed joint venture for creating and operating a streaming sports bundle.
  • In re Generic Pharmaceutical Pricing Antitrust Litigation (E.D. Pa.). Defending a generic pharmaceutical company in multi-district litigation, brought by private plaintiffs and state attorneys generals, involving an alleged price fixing and supply reduction conspiracy.
  • FTC v. Meta (D.D.C.). Representing technology company as a non-party in the Federal Trade Commission’s antitrust action against Meta.
  • In re Amitiza Antitrust Litigation (D. Mass.). Represented a generic pharmaceutical company in defense of claims brought on behalf of direct purchasers challenging an alleged “reverse payment” patent litigation settlement.
