George G. Gordon, former co-chair of the antitrust/competition group and the life sciences group, is a leading, nationally-recognized first-chair antitrust litigator whose practice focuses on antitrust litigation, government investigations and counseling, often on competition issues arising out of intellectual property strategies. He has successfully defended and, at times pursued, antitrust claims on behalf of numerous life science and other clients at every stage of litigation, including early stage dispositive motions, class certification, summary judgment, at trial, and on appeal.
By way of example, in recent cases, Mr. Gordon secured a defense verdict for our branded pharmaceutical client after a rare three-week antitrust jury trial of a “reverse payment” action (which the co-defendant settled for US$265 million), obtained a dismissal of an FTC case asserting a novel challenge to the terms of a patent licensing agreement and recently argued the appeal in the D.C. Circuit, and was a chief architect of the competition theories that resulted in our client, a cancer research institution, receiving a large lump-sum payment (and additional potential payments) to settle unfair competition claims based on an inventorship dispute regarding anti-PD-1/PD-L1 antibody patents.
In addition, Mr. Gordon also represents life science companies in disputes arising out of licensing, collaboration, asset purchase and other agreements. In addition to representing clients in the arbitration and litigation of such disputes, Mr. Gordon has helped clients develop pre-litigation/arbitration strategies to successfully negotiate favorable commercial resolutions.
For over 20 years, Mr. Gordon has been recognized as a top antitrust lawyer in Chambers USA. Chambers USA writes that he is “a very good lawyer” who “wins praise as ‘one of the top antitrust defense lawyers'” and that he is “smart, reasoned and reasonable.” The Best Lawyers in America formerly named him Philadelphia Antitrust Law “Lawyer of the Year” and consistently recognizes him for Antitrust Law and Litigation. Benchmark Litigation recognizes him as a national “litigation star” —he is also a “Leading Lawyer” in Legal 500 and ranked as a “Life Science Star” in LMG Life Sciences.
