Dechert Win in Damages Retrial Resurrects 2019 Trial Victory for Hitachi Maxell and Mondis Against LG
On February 7, a New Jersey federal jury returned a verdict ordering LG Electronics Inc. and LG Electronics USA Inc. to pay US$14.3 million to London-based Mondis Technology Ltd. and Japan-based Maxell Holdings Ltd. and Maxell Ltd., for infringement of a television display technology patent.
At an April 2019 trial, a jury found the patent valid and willfully infringed and awarded US$45 million. In post-trial motions, the court affirmed the validity and willful infringement findings, but deferred ruling on plaintiffs’ request for enhanced damages and fees until after a damages retrial. That trial has now concluded, and the court has ordered briefing on plaintiffs' claims for enhanced damages, fees and prejudgment interest.
