Dechert Client ACV Auctions Secures License to Critical Tech Platform Through Settlement of Litigation

February 26, 2024

Dechert client ACV Auctions, the leading digital automotive marketplace and data services partner for dealers and commercial clients, recently announced the settlement of its antitrust litigation related to the AutoIMS technology platform (ACV Auctions Inc. v. National Auto Auction Association, Inc., et al.).

Within the wholesale automotive remarketing sector, AutoIMS serves as a critical tool, facilitating connections and transactions among multiple levels of the automotive remarketing marketplace. In the summer of 2022, ACV filed the lawsuit following being denied access to an AutoIMS license.

Through this settlement, ACV secured an AutoIMS license and resolved the litigation. The license will enable the company to extend its services to the 1,300 commercial consignors that depend on AutoIMS to access numerous third-party auctions. Moreover, ACV can integrate AutoIMS to align with its digitally driven business strategy.

The Dechert team representing ACV in that lawsuit was led by antitrust partners Jay Jurata and Julia Chapman, as well as associates Erica Fruiterman, Forrest Lovett, David Costigan and Christie Boyden.
