Challenges to employers' use of independent contractors have risen dramatically over the last several years, and the past 12 months has been no exception. Federal and state agencies, led by the U.S. Department of Labor, have continued to view the use of independent contractors with extreme skepticism, and class action challenges to independent contractor arrangements remain an omnipresent risk for employers.
